1.0 General provisions

  1. We deliver and perform exclusively on our terms and conditions which are also valid for future business transactions, even if in the particular case a special reference to our conditions is lacking.
  2. Our conditions take precedence over any deviating conditions of the buyer.
  3. Verbal agreements require written confirmation by us to be effective.

2.0 Offer and order acceptance

  1. Illustrations of articles are only to be regarded as an indication. We reserve the right to make changes in packaging, design or in the technical area, which improve the quality of an article, even without prior notice.
  2. Our offers are subject to approval until acceptance of an order.
  3. Information on dimensions, materials, colors, construction and other features are approximate.
  4. Accepting an order will be sent by email or fax
  5. There is no minimum order value.

3.0 Prices and payments

  1. The following payment terms shall be deemed agreed: Onlineshop prices are inclusive 19% sat. VAT ex works D-14197 Berlin. The prices valid on the day of the order apply. – Prepayment abroad: transfer before shipment – the bank charges incurred are at your expense Payment : Paypal payment via our shopping cart system of website, paypal@aprilaromatics.com Advance payment: The delivery takes place after receipt of payment in our account Bank account: GLS BANK, Bank code: 430 609 67, Account: 1134478100, IBAN: DE 75 430 60967 1134478100, BIC: GENO DE M 1 GLS. The delivered goods remain the property of April Aromatics until complete payment.
  2. The prices mentioned on our pages include VAT.

4.0 Shipping

Delivery is carried out via DHL insured parcel shipping. Within Germany, we charge a flat shipping fee of €5.99 for insured parcels. Shipping is free for orders over €150. For international shipping we use Fedex Priority Express with a flat rate, depending upon the destination. For all other shipping options, please view the applicable rates for your order and shipping destination during the checkout process under “Shipping Method” (Step 3).

5.0 Delivery times

Delivery data are approximate. Delivery delay requires written reminder of the buyer. Other rights of the buyer as a rescission after a reasonable deadline, in particular, therefore, claims for compensation for a delay of delay are excluded.

6.0 Statutory warranty

  1. The statutory rights in respect of defects apply. Claims for defects become time-barred two years after delivery.
  2. Those rights apply independently of any right of withdrawal and independently of any commercial guarantee. No free manufacturer durability guarantee of more than two years is granted.
  3. Transport damage should be reported to the carrier on delivery where possible; statutory rights against us remain unaffected.
  4. Towards traders only: obvious defects must be notified without undue delay; the limitation period is one year from delivery unless longer mandatory periods apply.

7.0 Liability

  1. We are fully liable for intent, gross negligence, injury to life, body or health, and under the Product Liability Act.
  2. For slightly negligent breach of material contractual duties, liability is limited to the foreseeable, typical damage.
  3. Any other liability for slight negligence is excluded.
  4. These limits also apply to our vicarious agents.

8.0 Retention of Ownership

We retain ownership of the delivered articles until receipt of all payments from the business relationship. In the case of a breach of contract by the customer, in particular in the event of a delay in payment, we are entitled to take back the purchased item (s). In the withdrawal by us is no withdrawal from the contract. A possible realization proceeds are charged to the liabilities of the customer.

9.0 Returns

  1. If you are not completely satisfied with your purchase, you may request a return or exchange within 14 days of receiving your order. To be eligible, items must be returned in unused condition, with all original labels, packaging, and invoice included. We are unable to accept returns of products that have been opened, used, or have had labels removed or damaged.
  2. Customers are responsible for the return shipping costs, and we recommend using a trackable shipping method, as April Aromatics is not liable for returns lost during transit. Shipping charges from the original order will not be refunded.
  3. Refunds will be issued to the original payment method once the returned goods have been received and inspected. Please note that shipping fees, duties, and international taxes are non-refundable, though VAT (if applicable) will be included in the refund.
  4. Exchanges are dependent on product availability. If an item is found to be faulty, we will offer an exchange for the same item (subject to stock) or a full refund, provided the issue is reported within 14 days of delivery.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
